Romany01: The Zion verdict was pretty bad.
MacAtHome: Is that really CourtTV?
RRR737: not familiar with ZION either.
Romany01: CTV, have you seen Moore try other cases?
MacAtHome: So does anyone think the Aikita did it?
Jtgrafx: I Want CTV - I only get CNN.... :(
CourtTV: Libby Zion (18 years old) entered New York Hospital in 1984 with a
fever and earache. She
MacAtHome: No correction it was 3 Akitas with ski masks going down the alley.
CourtTV: died 8 hours later. Her father sued 4 doctors and the hospital for
negligence claiming they
CourtTV: injected her with a drug that was lethal in combination with another
drug she was on
Jtgrafx: Verdict?
Romany01: Not guilty on almost all counts.
CourtTV: I have not seen Moore try other cases but I'm told his style in this
same in all.
Romany01: Except the one where they really weren't guilty.
RRR737: Almost all counts?
Romany01: He was horrible. Probably drove the jury to distraction.
Jtgrafx: Did they not ask what medications she was on???
Romany01: Yes, found guilty on the lethal combination of Demoral and Nardil.
CourtTV: Three doctors were found liable for ordering the lethal injection.

Romany01: However, the fact that it was dangerous was not known at the time
of the death.
CourtTV: were cleared.

CourtTV: Nardil is an antidepressant.
Romany01: Was taking Nardil.

reaction possible.

Jtgrafx: Interesting - I was taking antidepressent Pamelor - dentist gave me
codeine - BAD REACTION
Romany01: I'd imagine.
Jtgrafx: wound up in hospital too
LawBuff: Beth, were you surprised by the verdict?
RRR737: antidepresents and barbituates are a bad mix - anytime
PennitoJW: not true knew of reaction several years prior to libby`s admission
Jtgrafx: dentist didn't ask and I didn't think to tell - my tooth was KILLING
ME
CourtTV: Yes. I thought the hospital would be found liable for the system it
had in place. No one
CourtTV: more senior than a junior resident saw Libby. The hospital was a
teaching hospital.
LawBuff: Did you talk to any of the jurors? Know how they reached their
verdict?
RRR737: definately sounds like the hospital had lousy system in place -
Teaching hospitals usually

Jtgrafx: New juror on...
CourtTV: The PDR listed the reaction between Demerol and Nardil as far back
as 1967.
Jtgrafx: excuse me - witness
Romany01: Good, RRR, if you say you don't want any residents or interns
touching you :)
CourtTV: I spoke with 4 of the 6 jurors. The defense was that Libby took
cocaine before entering
RRR737: It does help to be active in your own care
CourtTV: the hospital and did not tell the doctors. The defense said she
died of a cocaine/nardil
CourtTV: reaction. The evidence was ambiguous about the cocaine but the jury
bought it and
BOMOHAMMAD: Beth are you related to Alex?
CourtTV: found Libby 50% responsible for her own death.
Jtgrafx: Was there any compensation?
RRR737: 50% was enough to clear the doctors/hospital?
CourtTV: I'm not related to the former football player.
CourtTV: Yes. One dollar for wrongful death (that's all the plaintiff asked
for) and 375,000 for pain
CourtTV: and suffering.
LawBuff: Why did they only ask for one dollar?
Jtgrafx: kinda unusual?????
Mikerunner: it seems Libby was left alone for quite a long time while her
temperature kept rising
CourtTV: The plaintiff said he wasn't in this for the money. He sought
punitive damages against the
CourtTV: hospital and the doctors in order to make a statement about
residency training programs.
CourtTV: It was a gamble and he lost.
Mikerunner: wasn't this evidence of lack of sufficient care
TOI CAT: Beth have you spoken with Sidney? Does he feel 10 years were lost?
CourtTV: Libby's temperature was not taken between 2:45 am and 6:30 am. At
6:30 it was 108
CourtTV: degrees. She died shortly after.
Jtgrafx: Cardiac Arrest?? Fried Brain???
ThomasL137: What do you mean he gambled and lost?
CourtTV: Sidney is angry. He believes the jury bought the "lie" about
cocaine. Although he, in

CourtTV: large part lost, his "crusade" was still a victory. He succeeded in
changing the hospital
Otcinsight: The nurses didn't monitor the heartrate?
CourtTV: regulations in New York State regarding the number of hours
residents and interns work
CourtTV: and the level of supervision of them.
Mikerunner: Were any of the nurses named as defendants in the lawsuit?
Jtgrafx: gotta run for a while....dog time
ThomasL137: Too bad it doesn't apply in other states.
CourtTV: Libby's vital signs (including heart rate) were taken 4 times before
2:45 am. Not after.
ThomasL137: I'm a first year medicine resident at the University of Michigan,
and still work fairly
ThomasL137: obscene hours.
CourtTV: The nurses were not named in the suit although, arguably, they could
have been.

CourtTV: Thomas, how many hours do you work and how often are you on call?

Mikerunner: Were all four doctors held equally at fault?
ThomasL137: This month I'm on call every third night because I'm in the unit.
Non-unit months are every
CourtTV: Three doctors were found liable. Their liability was not
apportioned so they are all
CourtTV: equally at fault.
ThomasL137: fourth. In fact, I'm post-call right now. My hours vary, but
are usually greater than 85
ThomasL137: and have been over 110 during bad weeks.
Mikerunner: Which doctor was exonnerated?
ThomasL137: I get two scheduled days off per month.
CourtTV: Thomas, the New York regulations restrict on call hours to no more
than 24 with a
CourtTV: weekly aggregate of no more than 80. These regulations, however,
are violated
CourtTV: routinely, I'm told.
ThomasL137: I know.
Gleeper1: I am a resident also but we usually average about 80 hours a week,
including any time we might get to

CourtTV: The emergency room doctor was exonerated.
ThomasL137: We have several residents who went to school in NY and left out
of fear of the 24 hour law.
Gleeper1: sleep on call. We never have to work more than 28 hour in a row,
but often it's right at that.
CourtTV: Thomas, Why out of fear?
ThomasL137: Which program are you in Gleeper1?
ThomasL137: Because they feel the training may not be adequate.
Gleeper1: University of New Mexico--great program!
ThomasL137: Medicine?

Gleeper1: Yes. We have about 5-6 ward months that are 80hrs. One day off a
week no matter what!

KatieTried: So do you doctors think the new york hospital doctors were sleep
deprived?

Gleeper1: We have a cap on admits (10/team/night) and our attending covers
the team when we're off

deprived, but we get used to it

CourtTV: specifically read the contraindications. It clearly said not to

Mikerunner: Is there now a limit to the number of patients and intern can be
responsible for?

CourtTV: patient on an MAOI. The intern was in her 17th hour. She missed
the line that said
ThomasL137: Not in my program. General medicine months can be brutal.
KatieTried: Beth, are you in New York?
CourtTV: the combination could be lethal. Sleep deprived?
CourtTV: Yes, I'm in New York.
Mikerunner: How can any doctor reasonable be expected to care for 40 patients
at once?
JShambro: no
KatieTried: What does the city say about the verdict, what is Sid Zion
saying?
JCHenry500: no
CourtTV: Good point. The intern had 48.
ThomasL137: It's difficult.
Gleeper1: I think mistakes can happen sleep deprived or not. I've missed
things wide awake. But being tired
ThomasL137: I routinely cross cover that many patients on a call night.
Gleeper1: makes it easier to miss things.
CourtTV: The City wasn't a party to the action. Sid is very upset.
Patrick959: Doctors take that load at night all the time.
Mikerunner: Please explain "cross cover"
KatieTried: meant general reaction in the city at large :)
CourtTV: Within 40 minutes of receiving the Demerol injection
(intramuscularly) Libby started to
ThomasL137: The truth of the matter is, we all make mistakes, we just try not
to make big ones.
CourtTV: flip out. The nurses begged the intern to come and the intern
refused. Instead, the
CourtTV: intern ordered a Posey jacket. When that didn't work, the nurses
put Libby in 4-point
WLJ0412: No other "industry" besides health care will allow professionals
responsible for peoples

CourtTV: restraints. Finally, fifteen minutes later, she was given 1 mg. of
Haldol as a sedative.
CourtTV: She was dead 2 hours later. Should the intern have come to Libby's
side? The nurses
WLJ0412: lives to operate with sleep deprivation as the norm, not the
exception.

CourtTV: called 3 times in a fifteen minute period.

Mikerunner: What type of practice does Dr. Weinstein do today? How will this
judgement affect her?
Patrick959: The nurses can go over the interns head to the fellow or
attending,why wasn't that done?
CourtTV: Weinstein is an internist. She is also teaches at Cornell Medical
College.
KatieTried: Why were both sides afraid to call the medical examiner? Dying
to know
CourtTV: Patrick: Good question and one that many have asked. I don't know
the answer.
CourtTV: Moore told me the autopsy report and toxicology report speak for
themselves. It's

admit that night, the only

that is expected on our uni

the intern and resident

Mikerunner: What effect do you think Moore's personality had on the jury?
CourtTV: Mikerunner: I asked them that question. They thought he was a bit
too dramatic but
CourtTV: for the most part thought he did a fine job.
KatieTried: Did they say anything about Moore's wife ?
CourtTV: Katie: Not to me but I'll be speaking to them again. I'm curious
too.
KatieTried: I thought her obvious use of technique kind of exposed how much
of his style was technique
CourtTV: Katie: She mimicked his style too much. It became a distraction for
many viewers. She
Patrick959: It might be unusual there, but ultimately the attending is
responsible. So it the situation
CourtTV: actually did a good cross examination of the defense's toxicologist
but some of it was
Patrick959: warrants it, they should have called.
CourtTV: lost due to her style.
KatieTried: I agree completely
KatieTried: I thought Moore was surprisingly gracious on the "post-game show"
CourtTV: Patrick: The jury thought the attending was the most liable although
the verdict appears
CourtTV: to focus on the intern.
KatieTried: Did they think Sherman had lied about the Demerol, or just
forgotten?
Patrick959: What was the ultimate cause of death?
CourtTV: Katie: He was gracious. That's his personality. He's a deeply
religious man and
CourtTV: studied to be a priest at one time.

CourtTV: Katie: The jury believed Sherman knew about the Demerol via Stone's
call. They did not
CourtTV: say whether he lied or forgot.
